General Terms and Conditions of Road to the American Dream
1. Scope of Application
1.1 These general terms and conditions between Road to the American Dream (hereinafter “we”) and the client shall take effect immediately upon the conclusion of the respective contract for participation in the Green Card Lottery.
Only individually concluded and separately agreed assignments are valid for consultation and processing of any US Visa applications outside of the Green Card Lottery. We will be happy to provide these separately prior to the conclusion of the contract.
1.2 Any customer terms that conflict with or deviate from these general terms and conditions shall not be recognized unless we have explicitly agreed to their validity in writing. Our general terms and conditions shall also apply when we unconditionally carry out services while being aware of conflicting or deviating customer terms.
2. CONDITIONS FOR PARTICIPATION IN THE GREEN CARD LOTTERY
2.1. Contract Conclusion
2.1.1 Our service offerings described online, etc., do not constitute a legally binding offer. A legally binding contract is concluded when the client submits an application to participate in the Green Card Lottery either by post or digitally via the website https://road-to-america.com/.
2.1.2 When submitting an online application, the client’s order is placed after entering their personal data and clicking the “apply now” button. The client may correct their entries at any time during the process by clicking the “back” button. Until the “apply now” button is clicked, the client may cancel the entire process at any time.
2.1.3 Upon submitting the application at https://road-to-america.com/, the client will immediately receive an email confirmation of receipt. This acknowledgement confirms that the order has been received but does not yet constitute a legally binding acceptance.
2.1.4 A contract is only concluded when we confirm the order in writing or begin processing the application form. The client waives the right to a separate declaration of acceptance. Order confirmation may serve as the equivalent of contract conclusion.
2.1.5 For online submissions, we will store the contract text.
2.2. Cancellation Policy
2.2.1 Right of Withdrawal
The client may revoke the contract in written form (e.g. letter, email) within two weeks without giving any reason. The period begins after receipt of the cancellation policy in written form, but not before the contract is concluded and not before we fulfill our duty to provide information. The revocation must be submitted within the deadline to be valid. Please direct your revocation to:

2.2.2 Consequences of Revocation
If the contract is revoked successfully, both parties must return the services and any derived benefits (e.g. interest). If the client cannot return the received service in whole or in part, or only in a deteriorated condition, they must compensate us accordingly. Refunds must be issued within 30 days. The 30-day period begins upon submission of the cancellation for the client and upon receipt of the cancellation for us.
2.2.3 Special Condition
The client’s right of withdrawal expires prematurely if we begin to provide expressly agreed services before the end of the withdrawal period or if services are initiated by the client (e.g. downloads).
2.3. Scope of Services
2.3.1 We guarantee the client participation in the official United States Green Card Lottery. If the client wins, we provide guidance throughout the application process until the client receives the Green Card. We are not responsible for issuing an immigration visa or Green Card—this is the sole authority of the U.S. immigration services.
2.3.2 The client’s data will be submitted in due time to the responsible U.S. authorities in the proper format. If data is not submitted digitally, we will scan and format it accordingly, including any necessary photo processing. Once we receive confirmation of submission or access to the application, as well as lottery results, we will promptly notify the client.
2.3.3 The scope of services depends on the selected package: Basic, Smart, or VIP. All packages guarantee entry into the official U.S. Green Card Lottery and post-win support. If the client does not win, we will inform them annually by email and, if needed, by post about the next program.
2.3.4 We explicitly state that participation in the current Green Card Lottery is only possible if all required documents and complete data are received before the deadline. If missed, but submitted within two weeks, we will register the client for the next lottery at no extra cost. After this grace period, the application becomes void without refund and a new application is required.
2.3.5 If submission is not possible due to unforeseen events or external forces (e.g., war, embargo, tech issues, legal changes), either party may cancel the contract. In such a case, the client must pay a €35 processing fee. Both parties may prove higher or lower expenses.
2.4. Client Obligations
2.4.1 The client must provide all required information and materials (e.g. photos) in the specified format and quality before the deadline. The deadline will be communicated during the ordering process.
2.4.2 The client must submit accurate data and notify us of any changes. Multiple applications with different names or addresses are not allowed. We do not verify the truthfulness of submitted information.
2.4.3 The client grants us usage rights to submitted photos and guarantees no third-party rights are infringed. If a third party claims infringement due to unauthorized use, the client must indemnify us, including all legal defense costs (court and attorney fees).
2.4.4 We stress that winners must timely submit additional forms to U.S. authorities and attend the mandatory interview by September 30 of the year following the lottery result. Failure to do so results in forfeiting the Green Card right. The client must assist us by sending all required documents promptly and in an organized manner.
2.4.5 If the client fails to fulfill these obligations, we reserve the right to terminate the contract and/or seek compensation.
2.5. Prices
2.5.1 Prices are final and gross. They include VAT and all applicable service-related costs, including lottery participation and winner support.
2.5.2 Prices do not include optional services such as Premium winner consultation, or third-party costs (e.g., translation fees, notary fees, or U.S. authority fees).
2.5.3 Exclusive offers for individual packages will be shown on our website, in newspapers, etc.
2.5.4 Mail-in lottery entries are subject to an additional €5.00 processing fee.
2.6. Payment
2.6.1 Service fees must be paid in full upon processing the participation application.
2.6.2 Available payment methods will be presented during the order process.
2.6.3 If payment is not received within 10 days of application processing, the client is in default. We may charge default fees and/or cancel the contract. Interest is 5% above the base rate (8% for companies). Higher claims may be enforced.
2.6.4 We reserve the right to withhold services until full payment is received.
2.6.5 The client may only offset claims if they are uncontested and legally valid. The right of retention may only be exercised within the same contractual relationship.
2.6.6 If the client initiates a credit card chargeback without requesting a refund in writing and waiting two weeks, they must cover the resulting bank fees.
2.7. Liability Limitations
2.7.1 We accept unlimited liability for fraudulent concealment, guaranteed characteristics, product liability claims, injury to life/body/health, or gross negligence.
2.7.2 For other damages, we are only liable for breaches of essential contractual obligations, and only for damages foreseeable at the time of contract conclusion.
2.7.3 Any other claims are excluded regardless of legal grounds. In particular, we are not liable for loss of profit or economic disadvantages.
2.7.4 We are only responsible for our own website content at https://road-to-america.com. We are not responsible for third-party websites linked from our site and do not adopt their content. If we become aware of illegal content on linked websites, we will immediately disable the link.
2.7.5 Limitations also apply to our legal representatives and agents.
2.7.6 We are not liable for actions or inactions of U.S. authorities, including missed interviews resulting in forfeiture of the Green Card right.
2.8. Data Protection
2.8.1 We are committed to protecting users’ privacy and data. Personal data is treated confidentially and collected only as necessary under German Data Protection Law (BDSG) and Telemedia Act (TMG).
2.8.2 Client data is used primarily for processing the Green Card Lottery application. We do not share data with third parties, except U.S. authorities involved in the lottery. U.S. authorities are not subject to EU data protection standards.
2.8.3 Where permitted by law, we may use data for internal marketing purposes. The client can object or withdraw consent at any time by notifying us.
